BJP MLA accused of forging signatures to form society UPDATED: AUGUST 29, 2018 04:12 IST A Thane court has taken cognisance of a complaint against a BJP legislator, an IAS officer and seven others for allegedly registering a village cooperative society by forging documents. The Ulhasnagar magistrate court took cognisance of the complaint filed by Prabhu Govind Patil, who alleged that the accused unlawfully made him a member of the society by forging his signature. Mr. Patil in his complaint has alleged that Kisan Kathore, Murbad MLA, set up a cooperative society in 2011, of which he was the chief promoter. Mr. Kathore allegedly added 70 persons as members of the society using forged documents. Mr. Patil said several members had died even before the registration of the society. Magistrate Shailaja Pandey took note of the supporting documents submitted by Mr. Patil and ordered for issuance of process against the nine people, saying based on the first impression, the complaint buttresses the allegations. Issuing of process are the proceedings in any civil lawsuit or criminal prosecution and especially describes a formal notice or writ used by a court to exercise jurisdiction over a person or property. The court said, “Perused the complaint and documents which prima facie reveal that the society bearing name Sagav Parisar Vividh Karyakari Seva Sanstha was registered. Further, the death certificates of some members reveal that the society was registered in their names after their demise. Since the accused are promoters of the said society, prime facie it can be said that they have registered this society in the name of dead people by forging their signatures.” The court said that considering the complaint and the related documents, it can be inferred that the complainant has prime facie made out the allegations against the accused. The court issued process against the accused for offences punishable under Sections 420 (cheating), 408 (criminal breach of trust), 467 (forgery of documents), 468 (forgery for purpose of cheating), 471 (using as genuine a forged document) and 120 (b) (criminal conspiracy) of the IPC. 2018-08-27File case against BJP MLA: Court tells cops - Free Press Journal
File case against BJP MLA: Court tells cops Aug 27, 2018 06:51 am Mumbai: Ulhasnagar court directed the Kulgaon police in Thane district to register a case against Kisan Kathore, sitting legislator of Bharatiya Janata Party (BJP), senior bureaucrat RA Rajeev and eight other people for registering a village cooperative society with forged documents of some deceased members. Kathore, an MLA from Badlapur-Murbad constituency had submitted documents of four persons with their signatures (to the sub-registrar office of cooperative department) even though they had died at the time of registration of Sagav Parisar Vividh Karyakari Seva Sanstha (Sagav area cooperative service society) in 2011. Kathore also made senior bureaucrat RA Rajeev a working committee member without his knowledge and with his forged signatures on an affidavit. Justice Shailja Pandey, joint civic judge, Ulhasnagar, in the judgement stated that prima facie it reveals that the society was registered in the name of four deceased persons and to accordingly issue a process against the accused for offences punishable under Section 420 (cheating), 408 (criminal breach of trust), 467 (forgery of documents), 468 (forgery for purpose of cheating), 471 (using a genuine a forged document) and 120-B (punishment of criminal conspiracy) of the Indian Penal Code (IPC). Kathore had registered the society on August 6, 2011. He is chief promoter and chairman of the society whereas Dunda Borade, Yashwant Kathore, Jaywant Padare, Bhaskar Kathore, Vasant Borade, RA Rajeev, Liuse Vaiti, Pankaj Kanodia are directors of the society. Prabhakar Patil, complainant and director of Ulhasnagar Agriculture Produce Market Committee (APMC), had filed an application in the Ulhasnagar Civil Court seeking action against promotors and directors of the society under punishable sections for forging documents and listing his name as a director without his knowledge and forging his signature on the proposal to register the society. There are 73 members and Patil’s name is listed as serial number 62 in the list of registered members of the society. Patil in his plea denied having put his signature as member of the said society. “I brought this to the notice of the court through an application that I had never signed on any documents to become member of the society and that my signature was forged,” alleged Patil. He said, “I was surprised to know that some members like Tanaji Shelar, Jijabai Dhumal, Aambu Bhoir and Ramu Dohale had died before registration of the society in 2011, even though they are members of the society.” The court in its observation said that accused number one – Kisan Kathore – had sent the proposal to the district sub-registrar (co-operative) for society registration. “Perused the documents and death certificates of some members which reveals that the society was registered in their name after their death,” stated the judgement. It further stated that since the accused (Kathore) and nine others are promoters of the said society, prima facie it can be said that they have registered the society in the name of dead persons by forging their signatures. Rajeev, however on February 2, 2017 informed the joint registrar that his consent was not taken before making him a joint promoter/director of the society and clarified that he had not signed the documents. Prabhakar Patil approached the police station on April 20, 2017 to file a complaint against Kathore and other nine director, but the police are yet to take any action so he then approached the court.

We sprinkle disinfectant and take general precautions.” On the complaint, Shinde said, “There were a couple of cesarean operations scheduled that day, which made us empty the suction machines.

Businessman found dead in Ulhasnagar flat Updated: Aug 10, 2018, 04:37 IST Prakash Kachani was hit with a heavy object on head. A 55-year-old businessman was found dead in a flat in Ulhasnagar on Thursday morning with the police suspecting that he might have been killed in his sleep with a heavy object. Prakash Kachani, who owned a fabrics showroom in Ulhasnagar, lived with his family in a flat in Section 17. The flat in which he was found dead also belonged to him and is located in Hari Om Apartments, Chopra court. His family members said that he was not a regular visitor to the flat and went there once in two weeks or so. Police suspect that the murder might have taken place in the intervening night of Wednesday and Thursday, as Kachani returned to his home after finishing work on Wednesday night. Around 10 pm, he left the house for “some work”. When he didn’t return till late in the night, his two sons began searching for him and contacted his friends, business associates and relatives, but got no clue. On Thursday morning, the sons visited the flat in Hari Om Apartments and found the door ajar. “On entering, they found Kachani lying motionless on the bed with blood stains on the pillow and the mattress. He was only wearing his shorts, which suggests that he might have been killed in sleep,” said a police officer, adding that they are probing multiple angles, including robbery and business rivalry. Senior inspector of Central police station Vijay Dolas said, “A murder case has been registered. At present, the motive is not clear. We are looking at all possible angles.”

2018-08-08Noisiest city in state has no silence zones - Hindustan Times
Noisiest city in state has no silence zones Ulhasnagar was named the most noisy city in the whole of Maharashtra Updated: Aug 09, 2018 00:31 IST Ulhasnagar At 2am, music blares loudly from Gol Maidan. There are crackers bursting too. Honking from the roads add to the cacophony. This is a common noise pollution in Ulhasnagar, a town 58km away from Mumbai. Continuous vehicular movement and late night weddings and functions are the major causes of noise pollution, say experts. Little wonder then that Ulhasnagar was found to be the noisiest place in the state in a survey conducted by National Environmental Engineering Research Institute (NEERI). And the authorities are not bothered. The complaints by residents and activists, demanding noise regulation for the past 10 years, have fallen on deaf ears. “The roads in Ulhasnagar are narrow and vehicles many. Motorists get stuck in traffic and start honking,” said Sarita Harchandhani, an expert from Ulhasnagar, founder of Hirali Foundation, which has been fighting against noise pollution in the city since 2011. The study finding has highlighted the failure of the civic authority in curbing noise pollution despite of several warnings given by the Bombay high court in the past five years. This is evident as the Ulhasnagar Municipal Corporation does not have a separate environment department. “This is shocking as there are no officials meant to look after any kind of pollution. There are no silence zones or no-honking zones,” added Harchandhani. The UMC commissioner Ganesh Patil claims that there more than 50 silence zones in the city. “There are silent zones across the city. We have put up boards. The only problem is there is a lack of awareness among the public. The city’s population is increasing but its area remains the same,” said Patil. Hirali Foundation filed a petition against noise pollution in the Bombay high court in 2011. In 2016, the high court had passed an order to make sure noise pollution is controlled and loudspeakers are not allowed after 10pm. “Despite the order, the civic body did not take any steps to stop noise pollution. The event organisers get permissions from the civic body to hold functions anytime — at 4am and even at 11pm,” said Harchandhani. She added, “One of the major reasons why the city is not complying with the sound norms is the negligence from the authorities.” The Foundation measured noise level from 2011 to 2015 in the city. The study recorded around 72-80 dB in the morning and around 89-95 dB at night. Sometimes, the noise level touches 101 dB because of loudspeakers and bursting of crackers. In 2016-17, NEERI was appointed by the Maharashtra Pollution Control Board to map noise levels. As per NEERI, the noise level at night on weekends in Ulhasnagar was recorded at 86.7 dB. During daytime on weekdays, Ulhasnagar was found to be the noisiest, with maximum noise at 91.4 dB. The permitted noise level in a residential area during day is 55dB and at night is 45dB. Ulhasnagar is densely populated with 7 lakh. The Foundation alleged commercial units and shops are open till late. Ulhasnagar is a centre for the production of rayon silk, dyes, ready-made garments, electrical appliances and confectionaries. There is a continuous traffic flow across the city which leads to continuous honking. Marriages and other ceremonies are held at night and the celebrations, usually with DJ, continue till 3am. Gol Maidan is a popular place to host big and small events. The other places which have recorded the high noise levels are Birla Gate, Nehru Chowk and Netaji Chowk. As per the study, honking is the major cause of noise pollution in the city. “Every house has two to three vehicles. The roads have become congested. Youngsters honk continuously while riding on bikes. I think there is a need to train people on how to ride without honking,” said Geeta Lalwani, 35, a resident of Nehru Chowk, Ulhasnagar. Ulhasnagar deputy commissioner of police Ankit Goyal said that they have plans to appoint a consultant to study noise-related issues. “We have been registering cases against those using loudspeakers late at night. However, we cannot do much to curb honking. The civic body should impose silent and non-honking zones,” said Goyal, adding that they would conduct awareness programmes for residents. Shashikant Dayma, founder of NGO Waldhuni Biradri, said, “The city’s population might have reached to 10 lakhs although the civic body says it is 7 lakhs. The city has not expanded beyond its 13 sq km. The streets are narrow. Shops, commercial complexes and industries have mushroomed across the city.” The vehicle count in Ulhasnagar has seen an increase of around 12 per cent in 2017-2018. The city now has 82,942 vehicles. About Ulhasnagar Around 54 % of the total area of Ulhasnagar is residential area and 21% is occupied by the urban poor living in slums. Nine per cent of the area is used for commercial use. Industries cover 7.78 % area of the city, educational institutions, religious places, government offices and hospitals cover 6.3 % of the city. The remaining are the open spaces in the city that includes grounds, green spaces and gardens. Noisiest in the country In 2017, Jeedimetla in Hyderabad was the noisiest and Mumbai’s Wadala was the second noisiest among 70 locations across seven major cities in the country, in a survey conducted by the Central Pollution Control Board (CPCB). Wadala recorded 102 decibels (dB) at night, which is as loud as a home stereo system played at maximum volume, and 97 dB during the day as loud as a hair dryer. SOUND CHECK Gol Maidan: The civic body’s open ground is let out for public meetings and other functions. It has food stalls and people visit this place till midnight. Night: 10 pm to 2am (above 90 dB) Morning: Between 80 dB and 85 dB The noise level crosses 100 dB at night hours Nehru Chowk: It is a commercial space of the city with shops operating till midnight. Night: 10pm to 2am (above 90 dB) Morning: Between 80 dB - 85 dB Netaji Chowk: A narrow lane connects the chowk which has a continuous traffic flow. Vehicular honking is reported here as the roads are narrow and traffic jams are common. There are several shops located at both sides of this chowk. Night: 10pm to 2am (above 90 dB) Morning: Between 80 dB and 85 dB

2018-08-05Death of homeless woman in hospital: Ambernath NGO alleges negligence; asks police to file case - The Indian Express
Death of homeless woman in hospital: Ambernath NGO alleges negligence; asks police to file case “We run a helpline for homeless people and on that helpline we had got a call about her. When we reached the spot, she had been vomiting. We took her to the hospital and admitted her,” said Satyajit Burman, a member of the forum. Published: August 6, 2018 3:14:42 am An Ambernath-based NGO has levelled charges of negligence against the Central Hospital in Ulhasnagar after a homeless person admitted by it allegedly died under mysterious circumstances. The NGO has appealed to police to file a medico-legal case in the matter. Gita Jangiani (50) had been admitted to the hospital on June 11 by members of the NGO Ambernath Citizens’ Forum. “We run a helpline for homeless people and on that helpline we had got a call about her. When we reached the spot, she had been vomiting. We took her to the hospital and admitted her,” said Satyajit Burman, a member of the forum. According to him, her condition improved after a few days. “She was sitting up and talking to us. But they had not given her a bed and she was staying on the floor. When we complained, they agreed to give her a bed. Some of our volunteers also went to check on her and she had been doing well,” Burman said. But on July 8, the NGO members received a call informing them she had passed away that day. “We were shocked as she was making progress. The doctors could not give us a reason for the death. So, one of our woman volunteers, along with the female constable, checked her body and they found a deep wound on her upper thigh, which was not there when she had been admitted,” Burman said. He added, “There were scratches on her face. None of these were present when our volunteers had last visited her, a couple of days before her death.” Burman has appealed to the Central police station in Ulhasnagar to file a medico-legal case. “I have written to the police and they have responded. Just because she was a poor person with no family, no care was provided to her at the hospital,” he said. According to the police station, they have received Burman’s complaint. “We were waiting for the post-mortem report, which we received on August 4. The cause of the death is said to be septicemia. We have lodged an Accidental Death Report. But we are investigating,” an officer said. When contacted, civil surgeon Dr Sudhakar Shinde said: “Since the death was in July, I am not aware of all the facts. But I will look into the matter and get the facts.” He refused comment on the allegations of negligence.
